SOFTWARE LICENCE

This document is a legal agreement between you and the University of Queensland (�UQ�). You should carefully read this document. It creates important legal rights for your benefit, and it creates important legal obligations upon you.

1. If you submit the electronic registration form, you indicate your acceptance of the terms set out below.

Paragraph 2 to 4 in the case of a single user or student license:

2. UQ grants a non exclusive licence to you, to use one copy of the software product (�software�) which you download on a single stand alone computer. UQ warrants to you that it is entitled to grant this licence to you.

3. You may install the software on a hard disk on a single stand alone computer. You must not install it upon a network server. You must not permit any access to the software via any communications method.

4. You must not install the software on any other computer, unless you first delete the software from the computer in which it was previously installed. To do so is a breach of copyright, and a breach of this agreement.

Paragraph 2 to 4 in the case of a twenty user license:

2. UQ grants a non exclusive licence to you, to use the software product ("software") on a computer network or upon stand alone computers such that the maximum number of network stations and stand alone computers is 20 provided all stations and stand alone computers are physically located at the address indicated on the registration form. UQ warrants to you that it is entitled to grant this licence to you.

3. If a greater number of stations access the software from that network, you will need an extension of this licence. If a greater number of stations access the software without an extension of this licence, it is a breach of copyright, and a breach of this agreement.

4. If you need to use the software at a site in addition to those sites set out in paragraph 2, you will need an extension of this licence. To use the software at another site without an extension of this licence is a breach of copyright, and a breach of this agreement.

Paragraph 2 to 4 in the case of a site license:

2. UQ grants a non exclusive licence to you, to use the software product ("software") on a computer network or upon stand alone computers such that the maximum number of network stations and stand alone computers is 1000 provided all stations and stand alone computers are physically located at the address indicated on the registration form. UQ warrants to you that it is entitled to grant this licence to you.

3. If a greater number of stations access the software from that network, you will need an extension of this licence. If a greater number of stations access the software without an extension of this licence, it is a breach of copyright, and a breach of this agreement.

4. If you need to use the software at a site in addition to those sites set out in paragraph 2, you will need an extension of this licence. To use the software at another site without an extension of this licence is a breach of copyright, and a breach of this agreement.

5. The software is licensed to you. It is not sold to you.

6. You may copy the software for backup purposes only.

7. You must not use, copy, modify or transfer the software, otherwise than as specifically permitted by this Agreement.

8. You must not make copies of the software for third parties, nor permit others to do so.

9. The software, including text, music, images and audio incorporated in the software is protected by copyright laws and international treaties.

10. You must not rent lease or hire out the software.

11. You may provide the software to another person, but only if it is done on a permanent basis, you do not retain any copies of the software, and the recipient agrees to these terms and conditions.

12. You must not decompile or disassemble the software.

13. You may terminate this licence at any time by returning the software to UQ. In that case, you must delete all backup copies of the software.

14. If you breach any of the terms of this licence, UQ may terminate this licence. If UQ terminates this licence, you must return to UQ all copies of the software, and delete all copies of the software from any hard disk.

15. To the extent permitted by law, UQ makes no warranties in relation to the software whether as to merchantability or fitness for a particular purpose, or suitability.

16. All implied conditions, warranties and representations whether arising under statute or by implication of law, custom or usage with respect to the software, to the full extent permitted by law shall not apply.

17. UQ shall in no event be liable for any damage suffered as a result of the use of the software under this licence, whether direct, indirect, special, incidental or consequential howsoever arising whether under statute or from the negligence of UQ or by breach of contract by UQ or from an act or omission by UQ or otherwise.

18. This licence will be governed by the laws of Queensland, Australia.
